June 5, 2007 Board of Equalization Meeting Minutes

The meeting of the Ward County Board of Equalization was called to order by Chairman Watne at 10:08 a.m. with Comms. Fjeldahl, Gruenberg, Erickson and Lee present. Also present was Auditor/Treasurer Devra Smestad; Director of Tax Equalization Don Siebert; Ward County Appraiser Julie Hummel and Minot City Assessor Kevin Ternes.
 
Moved by Comm. Lee, seconded by Comm. Fjeldahl to freeze the assessment roll of the Unorganized Township 151-83 (Rushville Township) at the 2006 level, excluding properties with improvements. Roll call: all voted yes; motion carried.
 
Appearing for comment was Warren MacGillivray, Foxholm Township, requesting an appraiser review his home. Siebert informed the Board that he will meet with MacGillivray to review his home.
At 10:32 a.m. Comm. Lee left the meeting.
 
Also appearing for comment was Nancy Kennedy, Foxholm Township, requesting that an appraiser review her home.
 
At 10:34 a.m. Comm. Lee returned to the meeting.
 
Kennedy further requested that each home on Foxholm Township be reviewed, to which Siebert replied, the Foxholm local assessor is currently working on this process.
 
Dale Schlag, Kirkelie Township, appeared requesting a re-evaluation of his property where a gravel pit is located. It was moved by Comm. Lee, seconded by Comm. Fjeldahl to allow a maximum increase of 10 percent until a proper evaluation of Schlag’s gravel pit has been conducted. Roll call: all voted yes; motion carried. Chairman Watne directed Siebert to meet with Schlag to re-evaluate his property.
 
Terry Thiel, representing Gravel Products, appearing regarding their property in Kirkelie Township where gravel is located. Siebert informed the Board that he would review their three parcels as well.
 
Clint Cogdill, Kirkelie Township, appearing regarding his new home construction and his 2007 valuation. It was moved by Comm. Lee, seconded by Comm. Fjeldahl to set the value of his property at $140,000. Roll call: Comms. Lee, Fjeldahl and Erickson voted yes; Comm. Gruenberg abstained and Comm. Watne voted no; motion carried.
 
Siebert recommended approval of the 2007 assessments as follows: Minot City Residential – 96.9 percent; Minot City Commercial – 96.6 percent; Ward County Residential – 96.7 percent; Ward County Commercial – 96.1 percent; with agricultural land values the same as 2006. It was then moved by Comm. Lee, seconded by Comm. Fjeldahl that the 2007 valuations be frozen at the 2006 level, excluding properties with improvements. Roll call: Comms. Lee and Fjeldahl voted yes; Comms. Gruenberg, Erickson and Watne voted no; motion failed.
 
Siebert informed the Board that if the assessments were less than 95 percent, the State would direct the County Auditor to set the values at 97 percent.  It was moved by Comm. Erickson, seconded by Comm. Gruenberg to approve the 2007 valuations as recommended by the Assessors and to adopt the following resolution:
 
WHEREAS this Board of Equalization has reviewed the 2007 property assessments; and
 
WHEREAS, a number of errors and inequalities have come to the attention of this Board; and
 
WHEREAS, the County Auditor/Treasurer and the Director of Tax Equalization have reported that the notices of increases and decreases have been given to the owners and local equalization boards as provided by law, and opportunity to be heard in protest in such changes have been given;
 
NOW, THEREFORE, BE IT RESOLVED, that all returns as made by local equalization boards be approved except for changes ordered by this Board, and that all actions taken by this Board of Equalization be confirmed, and that such revised assessments be noted on the County Assessment rolls and included in the report to the State Tax Commissioners, which is now being compiled by the County Auditor/Treasurer’s office.
 
Roll call: Comms. Erickson, Gruenberg and Watne voted yes; Comms. Fjeldahl and Lee voted no; motion carried.
 
Siebert informed the Board that he would follow up with those making personal appearances today requesting review of their property and will be returning to a future meeting with his recommendations for their values.
 
With no further business to come before the County Board of Equalization, the meeting recessed at 11:37 a.m.
