AGENDA

 

1.     Call to order, roll call and determination of quorum.

2.     Review and approve the minutes of the last meeting held January 12, 2012.

3.     Public hearing for a variance by Dale Rodgers for the following described property:]

Lots 13-18 Block 11 and Lots 1-12 Block 12 Niobe, Plus Adjacent Vacated Kent Street, Section 18-160-89, Elmdale Township

      This variance application is to locate a 40' x 80' accessory building within the public ROW.  Current location of building is 15' from CL of 431st Ave NW.  Setbacks for a rural subdivision road are 40' from CL.  This application is after the fact. 

4.     Public hearing for a special use permit by Dale Rodgers for the following described property:

Lots 13-18 Block 11 and Lots 1-12 Block 12 Niobe, Plus Adjacent Vacated Kent Street, Section 18-160-89, Elmdale Township

This special use application is to allow applicant to service and repair semi-trucks in the accessory building that is located on said property.

5.     Public hearing for a variance by David Herzig for the following described property:

S2E2, S2SW, Section 8-156-84, Kirkelie Township

NWNE, N2NW, Section 17-156-84, Kirkelie Township

This application is to allow reduction in the lot size requirement of two acres.  Applicant intends to subdivide +/- 64 acres into 1/3 acre lots for a total of 120 lots.  The proposed location for subdivision is at the dead end of 128th Street NW;  an unimproved township road. 

6.      Public hearing for a special use permit by Gerald Koble for the following described property:

Outlot 2 of NWSW, Section 21-156-84, Kirkelie Township

This application is to allow two conditional uses on said property:

1.     The parking and servicing of semi-trucks:  owner is in the trucking business and owns three semi's and has completed construction of a 50' x 100' accessory building in which the trucks will be serviced and parked.

2.     Applicant is requesting allowance to place temporary RV parking for 6-8 sites located on said property with full sanitary, plumbing and electrical hook-ups.  Mr. Koble also intends to have RV's park inside a proposed accessory structure during inclement weather with full hook-ups.

7.     Plat application by Brian Sys for the following described property:

NWSW, Section 12-156-84, Kirkelie Township

This application is for a 10 acre parcel located on 86th Street NW with access by a 40' driveway approximately 367' from 86th Street.

8.     Final plat application by Dave Rose and Vince Heuvein for the following described property:

Coulee View Estates Being Outlot 1, Section 11-153-82, Willis Township

This application is for a six lot subdivision with lots ranging in size from 2.00-2,59 acres.  Access points will be from Township Road 86th St SE and County Road 18.  The Willis Township Board and the Water Resource Board have not responded.

9.     Other Business:

Suggestions that may be considered for adoption to existing Ward County Zoning Ordinances:

A.     Regulations proposed by First District Health for all temporary housing.  Staff recommendations:

i.     Adopt a mandatory bond limit          0-50 persons          $100,000

       issued to Ward County                   50-150 persons       $250,000

                                                             150-300 persons     $350,000

                                                             301 or more            $500,000

ii.     Housing permit issued for operating in Ward County--reviewed every 12-24 month time period for renewal.

iii.    Fee schedule:  $250-$400 per bed, or $1.50 per sq. ft. per unit per year.

iv.    Permit requirements:  site plans, closure plans, fire and emergency plans, reclamation plans, parking and transportation plan and on-site security plan.

B.     Redistricting of Zone 6.  Staff recommendations:

i.     Redistrict 2 to 6 in sections 32,33, 34-156-82, McKinley Township

C.     Set a minimum acreage allowed for horses.  Staff recommendations:

D.     Changing regulations for allowed use from one zone to another.  Staff recommendations:

i.     No cross referencing from one zone to another. 

E.     Move all definitions to one section.

F.     Clarification of identifiable use in each zone district and special use application process.  Staff recommendations:

i.     Add the following to special use permits:  wind towers, boarding houses, mobile home parks, RV parks, gravel yards or quarries, communication towers.

G.     Joint jurisdictions agreements.

H.     Further define cross references.

I.     Define the amount of parking spaces for commercial trucks to residential lot.  Staff recommendations:

i.     No more than two semi-trucks per outlot.

J.     Currently Ward County has adopted IRC, IBC, for condemnation purposes, The following sections will need to be referenced:

Section 115.1 - Unsafe Structures and Equipment - "Structures or existing equipment that are or hereafter become unsafe, insanitary, or deficient because of inadequate means or egree facilities, inadequate lighting and ventilation, or which constitutes a fire hazard, or are otherwise dangerous to human life or the public welfare, or that involve illegal or improper occupancy or inadequate maintenance, shall be deemed an unsafe condition.  Unsafe structures shall be taken down or removed and made safe, as the building official deems necessary and as provided for in this section.  A vacant structure that is not secured against entry shall be deemed unsafe."

Section 115.3 - Notice - "If an unsafe condition is found, the building official shall serve on the owner, agent or person in control of the structure, a written notice that described the condition deemed unsafe and specifies the required repairs or improvements to be made to abate the unsafe conditions, or that requires the unsafe structure to be demolished within a stipulated time."

Section 104.6 - Right of Entry - "Where is it necessary to make an inspection to enforce the provisions of this code, or where the building official has reasonable cause to believe that there exists in a structure or upon a premise a condition which is in contrary to or in violation of this code which makes the structure or premises unsafe, dangerous or hazardous, the building official is authorized to enter the structure at reasonable times to inspect or to perform the duties imposed by this code, provided that such structure or premises be occupied that credentials be presented first to the occupant and entry requested.  If such structure be unoccupied, the building official shall first make a reasonable effort to locate the owner or other person having charge or control of the structure or premises and request entry.  If entry is refused, the building official shall have recourse to the remedies provided by law to secure entry."

Section 114.1 - Stop Work Order - "Whenever the building official finds any work regulated by this code being performed in a manner either contrary to the provisions of this code or dangerous or unsafe, the building official is authorized to issue a stop work order."

10.     Other business or adjourn.
